Can marijuana foods be laced with LSD?
Czech drug laws
Prague's liberal legislation and policies mean the city has earned a reputation for being drug-friendly, and it is estimated that nearly half a million marijuana users are largely ignored by the authorities and tolerated by almost everyone. Most of the pubs and non-touristy bars outside the center allow you to smoke marijuana inside. But don't try to light any of that stuff in a dance club! Drug possession is illegal in the Czech Republic and on January 1, 2010 the government set the limits of possession for an administrative offense and a criminal offense.
What are the essential quantities?
As reported in other sources, it is an administrative offense to possess drugs up to the following amounts: (To be clear, if you have less than the listed amount, it is still illegal, but not a criminal offense - just a violation)
Here are the quantities you can get in the Czech Republic “legal“ may have in your possession:
Five hemp plants or 15.0 grams of marijuana, 40 pieces of magic mushrooms, 5.0 grams of hashish, five LCD-laced papers or other materials with LSD, 1.5 grams of heroin, 1.0 grams of cocaine and 2.0 grams of methamphetamine.
These limits have nothing to do with any of the substances being legalized. As an administrative offense, possession of drugs in the above amounts can result in a fine of up to CZK 15,000. However, since this is only a violation, people who are accused of this type of property are not given a name entry in the criminal record.
The question of whether this is liberal will depend on enforcement by the police. In general, the Czech Republic has a fairly liberal reputation when it comes to marijuana use. Personal observations and anecdotal evidence suggest that marijuana use is more open compared to other European countries. However, criminal possession of drugs can result in a prison sentence of up to two years.
For many, the downside of more permissive drug laws is adequate secondary and tertiary prevention, that is, prevention for those who are already using them. There is a large network of these services throughout the Czech Republic: mostly non-governmental outpatient counseling and treatment, home care, replacement programs, street social work, etc. The languages spoken in different institutions vary, but are the most common it english. One such organization is Drop In Prague (www.dropin.cz), which has programs, advice, exchange of needles, food, HIV and hepatitis tests, replacement programs, administration of methadone in the form of Subutex, a center for aftercare, a center for families, and a street social work program.
The new term enacted by the court “More than a small amount of drugs” (April 2014)
What does that mean: more than a small amount of drugs? The Supreme Court responded to that question on Wednesday when it closed down the exact numbers by which the judicial authorities and police should act. Contrary to common practice, the judges agreed on stricter limits for marijuana and methamphetamine. They justified the decision with the increasing number of users and the emergence of mass production.
The numbers were recently changed by a government ordinance, but they have been overturned by the Constitutional Court. The press spokesman for the Supreme Court, Petr Knötig, pointed out that the figures are only guidelines and that it is always necessary to take other circumstances of the case into account.
“Because 'more than a small amount' is generally understood to mean having the amount of a drug, psychotropic substance or poison that, multiplied by the harmful effects of each substance on human life and health, is the usual dose of one ordinary consumer. Finally, […] the difference between a first-time user and whether the user of these substances is at an advanced stage of addiction should be taken into account, as well as other factors, if any, that indicate the extent of the threat to life or affect the health of users, ”said judges of the criminal chamber.
The increasing number of plantations is alarming
For meth, for example, “more than a small amount” is now the unified view of the Supreme Court as 1.5 grams of the drug, just like heroin. For cocaine, the amount is set at more than one gram. For marijuana, the judges determined that this amount was 10 grams dry weight.
This is a stricter benchmark than the previous government regulation. The number of young users and large plantations is growing.
“The Vietnamese minority in particular is involved in these criminal activities. The increasing number of plantations discovered and the quality of marijuana produced since 2007 is extremely alarming, ”the judges wrote.
The term “more than a small amount” appears in several articles of the Criminal Code. The criminalization of the users in possession of the various drugs depends on the interpretation of this term.
