Wasserburg / Rosenheim -An alleged parcel carrier had given the 28-year-old the online package containing 40 grams of heroin and five grams of the purest cocaine. However, the alleged parcel delivery person immediately identified himself as a detective who arrested the defendant for drug possession and, together with his colleagues, searched the apartment for more drugs.

The contents of the delivery had been removed before use and exchanged for neutral material.

Defendant fully confessed

In the trial before the Rosenheim district court, the 38-year-old confessed extensively, but claimed that he had only acquired the drugs for personal consumption. The officials from the drug department at the Rosenheim inspection confirmed that no evidence of drug trafficking had actually been found.

The defendant reported that he was addicted to sugar as a child. It was therefore an obvious choice to have his first career choice: confectioner. Because of the manageable income, the defendant had also looked for other sources of income. Again and again he took up further training, because of the meanwhile developed addiction to cocaine and heroin he broke off all attempts again and again.

In addition to the substitution with methadone, he repeatedly resorted to hard drugs, the defendant said.

No criminal record

The fact that the defendant had no previous convictions caused astonishment. Forensic psychiatric expert Dr. Josef Eberl was also astonished that during the substitution no check was carried out to determine whether the defendant was also using other drugs. In fact, however, a real willingness to therapy can be seen in the test person. After all, he has already applied for therapy on his own initiative. Long-term withdrawal therapy has never been carried out with the defendant either. From the expert's point of view, this is urgently advisable. He did not want to stipulate whether a therapy had to be completed in a closed penal system.

No evidence of drug trafficking

In her closing lecture, the public prosecutor's office confirmed that the accused had not been involved in drug trafficking. Therefore it remains with forbidden possession. But because it was not the merit of the defendant that the drugs had not reached him in two cases of earlier orders, she did not want to allow him the mitigating circumstance of an attempt. Because the amount of hard drugs involved was significant, she petitioned him to be sentenced to two years and ten months in prison. To this end, the court should order him to undergo therapy in a closed prison.

The defense attorney, attorney Harald Baron von Koskull, pointed out that it was a first-time offender who had never been convicted and whose stated aim was to get away from the fatal drugs. It could definitely remain with a suspended sentence, with which one should help his client with strict therapy requirements.

The court of lay judges, chaired by Judge Christian Merkel, finally followed the defense counsel's request. She was suspended for two years in prison. However, on the condition that the defendant begins long-term inpatient therapy, repeatedly proves that he is drug-free with tests and is subject to supervision by a probation officer.

If he relapsed into drug addiction, he would have to go to prison immediately. "That should be enough motivation," said Richter Merkel.
